Introduction

This is an Agreement between you (the “Client” or “You”) and Active Ascension, Inc. (the "Practitioner" or "Us").

It is important that you read these terms and conditions to ensure they are understood and agreed by you. By placing an order with us for any services you are accepting these terms and conditions and agree to be bound by this Agreement.

Acknowledgement and Consent to Receive Services

You, the Client, have read and understand the services offered by Melissa Griffiths and her training and education. Melissa Griffiths is not nor will not be held liable for failure to diagnose or treat an illness, nor will she be liable for failure to prevent future illness. You understand that Melissa Griffiths is not a licensed physician. You understand it is your responsibility to maintain a relationship for yourself / your child with a medical doctor or licensed health provider. You have consented to use the services offered by Melissa Griffiths and agree to be personally responsible for fees incurred in connection with the services provided. You agree to hold Melissa Griffiths and Active Ascension, Inc. harmless for any claims or damages in association with our work together. If you, the Client, suspect you may have an ailment or illness that may require medical attention, then it is your responsibility to consult with a licensed physician or medical healthcare provider immediately. Only a licensed physician can prescribe or discontinue pharmaceutical medications. In addition, you have given Melissa Griffiths a complete and accurate account of any medical conditions that you may have and any medications that you are taking. You are here as an individual on your own behalf and do not represent any other person, entity, and / or governmental agency.

Payment

All appointments are pre-paid and non-refundable. You, the Client, understand that a 24-hour notice to change or re-schedule any appointments must be given or a full-session fee, or package session credit, will be charged. Cancellations under 24 hours or no-shows will be charged the full missed session fee. If you, the Client, plan to arrive late, you will send a note before the session is scheduled to begin. Sessions will be considered “no-show” at 20 minutes past start time and a full session fee will be automatically charged. A total of 2 reschedules are permitted before the session will be considered a no-show. All services and sessions are non-refundable and all sales are final. 

Confidentiality & Privacy

This Agreement should be read in conjunction with any policies, including the Privacy Policy, which can be found on the Practitioner’s website. The Practitioner agrees not to disclose, reveal or use any Confidential Information unless authorized by the Client or required by law. This shall survive indefinitely upon termination of this Agreement. All written and oral information and material disclosed or provided by the you, the Client, to the Practitioner is Confidential Information regardless of whether it was provided before or after the date of this Agreement or how it was provided to the Practitioner.

Indemnification

To the extent permitted by applicable law, each Party agrees to indemnify and hold harmless the other Party against any claims, losses, damages, liabilities, expenses and costs of any kind which may arise from any act or omission that occur in connection with this Agreement and this clause shall remain in effect following the termination of the Agreement.

Waiver

The waiver by either Party of a breach of any term or provision of this Agreement by the other Party, which must be in writing, shall not be construed as a waiver of any subsequent breach of any similar or dissimilar term or provision at the same or any earlier or subsequent time.

Entire Agreement

The Parties agree that all of the representations, warranties and conditions affecting this Agreement are expressly set out in this Agreement.

Governing Law & Complaints

These Terms will be governed by and construed in accordance with the laws of the State of Oregon, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Oregon for the resolution of any disputes. Be advised that any lifestyle or holistic wellness program suggested is not intended as a treatment for any disease. The intent of any lifestyle, or holistic wellness recommendation is to support the physiological and biochemical processes of the human body and not to diagnose, treat, cure, prevent any disease or condition. You should always consult with a qualified medical professional before making changes to your diet, prescription medication, lifestyle, or exercise activities. We recommend that you inform your medical doctor that you are receiving nutrition or mind body energetic services. If you ever have any concerns about the nature of our services or our work together, please contact the Practitioner right away.

Agreement

To avoid any disputes, any issues or complaints should be submitted in writing to the Practitioner who shall provide a written response within a reasonable time.
